Waiver and Release of Liability - The ARC
By selecting the checkbox and submitting your agreement, you confirm that you have read, understood, and agreed to the following terms and conditions regarding participation in "The ARC (Afterschool Recreation Club)" program (referred to as “the Program”), conducted in Florida and Ohio.
Assumption of Risk
I acknowledge that participation in the Program, which includes activities such as creative writing exercises, field trips, hands-on projects, swimming, walking outside across streets, music, and other related events, comes with potential risks. These risks may include but are not limited to physical injury, illness, property damage, or loss. By allowing my child to participate, I voluntarily assume all risks involved, whether foreseeable or not.
Release of Liability
On behalf of myself, my child, heirs, assigns, and representatives, I release and discharge Reaching All in Need (RAIN), its Board Officers and Directors, The King's Chapel in Akron, New Heights Church of the Nazarene (Akron), GracePointe Church of the Nazarene (Lake Mary), Akron First United Methodist Church, Helping2OvercomeSystems LLC, program volunteers, staff, associated partners, and all other affiliated entities from any claims, demands, actions, or liabilities resulting from or related to my child’s participation in the Program.
Acknowledgment of Supervision
I understand that while Program staff, volunteers, and leaders will provide supervision and guidance, participants are expected to adhere to instructions, safety protocols, and behavioral expectations outlined by the Program. I acknowledge that RAIN and its associated entities cannot guarantee the absence of all risks or incidents.
onsent to Medical Treatment
If a medical emergency arises, I authorize Program staff or representatives to administer or seek appropriate medical care on behalf of my child. I assume full financial responsibility for any medical treatment provided and release the Program and its affiliates from liability in connection with such care.
Field Trips and Transportation
I hereby consent to my child’s participation in field trips or off-site activities organized by the Program. I acknowledge that transportation for such activities may be arranged by Program staff, volunteers, or contracted services, and I release all parties involved from any liability associated with travel or related activities.
I understand that the Program will notify parents or guardians of upcoming trips via email, text message, or phone call prior to departure. While the Program will make every effort to provide 24 hours' notice, I recognize that due to the dynamic nature of Program operations, trips may occasionally be scheduled with limited notice.
It is the responsibility of the parent or guardian to ensure that their contact information is accurate and up to date with the Program to facilitate timely communication. Failure to provide accurate contact details may result in delayed or missed notifications. The Program will follow all established protocols to ensure the safety and well-being of participants during transportation and off-site activities.
Media Release
I consent to the use of photographs, videos, or other media featuring my child while participating in the Program for promotional or educational purposes. I waive any claims for compensation, ownership, or further approval regarding the use of such materials.
Adherence to Program Policies
I agree to ensure that my child complies with all rules, policies, and instructions provided by the Program staff or representatives. I understand that lack of compliance may result in my child’s removal from the Program without eligibility for a refund.
Indemnification and Unforeseen Incidents
I acknowledge that unforeseen events, accidents, or adjustments to planned Program activities may occur. I agree to indemnify and hold harmless RAIN, its officers, board members, volunteers, program staff, and partners from any claims or losses resulting from such incidents.
